Prahsant Sharma & Ms. Vandana Chauhan, Ld. Counsel for the defendant no. 1 and 2. Ld. Counsel for the defendant submits that on last date of hearing an application u/O 8 Rule 1 CPC was filed on behalf of defendant no. 2 seeking the liberty to read the WS on defendant no. 1 as that of defendant no.2 as well. The reply to the said application was to be filed by the plaintiff. The said reply was not filed but the defence of defendant no. 2 was struck off. Clearly, this appears to be an error apparent of the place of record hence this court suo moto reviews the same to be effect that the defence of defendant no. 2 is not struck off till the time the application u/O 8 Rule 1 CPC is pending adjudication. Further, it was mentioned in order dt. 14.03.2026 that plaintiff has filed replication against the WS alongwith reply to application u/O 39 Rule 1 & 2 CPC filed by defendant no. 1. This also appears to be typographical error and same stands corrected to the effect that replication was filed by plaintiff against WS and reply was filed on behalf of defendant no. 1 against application u/O 39 Rule 1 & 2 CPC. Further plaintiff was directed to supply the legible copy of the documents annexed with this application u/O 7 Rule 14 CPC read with Order 8 Rule 9 CPC to the defendant which he has not done till date. Last and final opportunity is granted to the -- 1 of 2 -- plaintiff to supply the legible copy of the same to the defendant at least a week before NDOH against acknowledgment. Defendant is directed to supply the advance copy of the reply to the application u/O 7 Rule 14 CPC to the plaintiff at least 3 days before NDOH against acknowledgment upon receiving the legible copy of the application. List the matter for consideration of application u/O 8 Rule 1 CPC moved on behalf of defendant no. 2, arguments on application u/O 7 Rule 14 CPC read with Order 8 Rule 1 CPC and further proceedings on 26.05.2026.
