Matter is listed for clarifications, however, it is stated by the Ld. Counsel for the plaintiff that he wants to drop the relief sought in the prayer clause for money decree in favour of the plaintiff and against the defendant for recovery of arrears of rent amounting to the tune of Rs. 1,15,800/- with pendente lite and future interest@12% per annum till the realization of the said amount. Separate statement of the Ld. Counsel for the plaintiff has been recorded to this effect. In view of the statement of the Ld. Counsel for the plaintiff, the aforesaid relief for recovery of arrears of rent amounting to the tune of Rs. 1,15,800/- stands dropped. Submissions heard. Suit file perused carefully. Issue summons of the suit for settlement of issues and notice of the application U/o 39 Rule 1 & 2 CPC to the defendant(s) on filing of PF/RC for the next date of hearing.
