Present: Sh.Mohit Dhama, Ld. Counsel for the plaintiff with
plaintiff.
Ms. Aarti Verma, Ld. Counsel for the defendant with
defendant no.1.
Sh. Atul Sharma, Ld.LAC for defendant no.1.
Matter already settled qua D-2.
An application for waiver of cost imposed upon D-1
along with fresh Vakalatnama filed on behalf of the defendant
no.1. It is stated that the WS was supplied to the Ld.counsel for
plaintiff and acknowledgment was taken on 08.04.25.
Considering that fresh Vakalatnama has been filed
on behalf of the D-1 today, Ld.LAC Sh.Atul Sharma stands
discharged in the present case.
Considering the above averments, in the interest of
justice, cost imposed upon D-1 on last date of hearing on
26.11.25 stands waived. Application is disposed off accordingly.
Replication filed today. Copy supplied. Ld.Counsel
for plaintiff opposed the application.
Pleadings are complete. On the pleadings of the
parties, following issues are being framed :-
1. Whether the plaintiff is entitled to decree of mandatory
injunction directing the defendant no.1 to vacate and handover the
peaceful and vacant possession of the suit property which is

ground floor consisting of one shop at property bearing no. B-6,
New Seelampur Delhi shown in red colour in the site plan?OPP
2. Whether the plaintiff is entitled to decree of permanent
injunction restraining the defendant no.1 from creating any third
party interest in the suit property?OPP
3. Whether the plaintiff is entitled to damages/mesne profits
and the rate of Rs.6,000/- per month from the defendant no.1 ?

4. Relief.
No other issue arise or is pressed for.
List of witnesses by both the parties be filed within
15 days from today with advance copy to the other side.
Affidavit of evidence of PWs be filed on or before
NDOH with advance copy to the defendant at least one week
prior to the NDOH.
Put up for further proceedings/ PE on 04/02/2026.
