Present: Mr. M.L. Gupta, Ld. Counsel for the plaintiff along
with plaintiff in person.
Mr. Neeraj Chauhan, Ld. Counsel for the defendant
no. 1 along with defendant no. 1 in person.
Matter already settled qua defendant no. 2.
An application under Order 16 rule 1 of CPC has
been filed for taking on record the list of witnesses. Copy
supplied to the opposite side.
It si submitted by Ld. Counsel for the plaintiff that
the aforesaid application has not been filed within time due to
inadvertent error and an opportunity be given to the plaintiff to
bring on record the aforesaid list of witnesses.
Submissions heard.
Considering the averments, the aforesaid application
is allowed and the list of witnesses is taken on record.
Accordingly, the witnesses mentioned in the list be
summoned along with the requisite records on filing of PF and
payment of diet money to the witnesses at the spot itself, to be
returnable on the next date of hearing.
Steps be taken within one week from today.
The application stands disposed off accordingly.
Put up for PE on 22.10.2026.
