Sh. Ashish Aggarwal, Ld counsel for defendant.
Ld counsel for defendant seeks waiver of cost by submitting that
defendant is a poor person. Heard.
In view of the submissions and in interest of justice, the cost of Rs.
1000/- is hereby reduced to Rs. 500/-. Let the same be paid to the plaintiff, today
itself.
Pleadings have been completed. Ld. Counsel for both the parties submit
that there is no documents for admission/ denial.
Prayer has been made for framing of issues in the matter. Heard.
On the basis of the pleadings of the parties, the following issues are
framed:
1. Whether the plaintiff is entitled for a decree of possession
in respect of the suit property?
(OPP)
2. Whether the plaintiff is entitled for decree of recovery of
arrears of rent, as prayed for in Prayer Clause (ii) of Plaint?
(OPP)
3. Whether the plaintiff is entitled for the decree of damages
as prayed for in Prayer Clause (iii) of the plaint?
(OPP)
4. Whether the plaintiff is entitled for the decree of permanent
injunction as prayed for in Prayer Clause (iv) of the plaint?
(OPP)

5. Whether the plaintiff is entitled for the decree of mandatory
injunction as prayed for in Prayer Clause (v) of the plaint?
(OPP)
6. Whether the plaintiff is entitled for the decree of mandatory
injunction as prayed for in Prayer Clause (vi) of the plaint?
(OPP)
7. Whether the plaintiff is entitled to maintain the instant
suit? (OPD)
8. Relief, if any.
No other issues arises or pressed upon by the parties.
List of witnesses be filed by plaintiff within 15 days from today.
Evidence by way of affidavit be filed by the plaintiff and copy of the same be
supplied to the opposite party at least a week prior to the NDOH.
