Fresh suit for recvoery of possession, arrears of rent, permanent
and mandatory injunction received by way of an assignment. It be
checked and registered.
Present : Ms. Niharika, Ld. Counsel for the plaintiff.
Heard. File perused.
Issue summons for settlement of issues along with notice of
the application u/o XXXIX rule 1 and 2 CPC to the defendant on filing of
PF/RC, returnable on 28.03.2023
The Process Server shall make an endevour to serve a copy
of the process by tendering or delivering it to the party personally i.e.
defendant herein. He shall also make all proper efforts to find the party
with a view to effect personal service and if it is not possible after
reasonable endeavour to find the party then only the service may be made
on an adult male member of the family residing with the defendant. In
case of refusal and avoidance of service, the concerned process server
shall also make an endevor to get the service effected by way of
affixation as well.
Steps be taken within 7 days from today.
