Sh. Wahid Ali, Ld. Counsel for both the defendants.
Vakalatnama of Ld. Counsel for the defendants is on
record. One application has been filed by Ld. Counsel for the
defendants under Section 151 CPC for direction to the plaintiff to
supply complete set of documents.
At this stage, complete set supplied to Ld. Counsel
for the defendants. However, Ld. Counsel for the defendants
submitted that the copy of the GPA and Agreement to Sell is not
legible. It has come to my notice that the copy of the said
documents which is on record is also not legible but at this stage,
Ld. Counsel for the plaintiff submitted that he does not have the
originals of these documents and he was in possession of only
photocopies which are in similar state in so far as legibility is
concerned. In view of the submissions made by Ld. Counsel for
the plaintiff, no further direction is being given to Ld. Counsel
for the plaintiff for supplying of legible copies to the other side.
The Ld. Counsel for the defendant is at liberty to inspect the
Court file in this regard and make appropriate averments qua the
said documents in the Written Statement.

The above mentioned application of the
defendants under Section 151 CPC accordingly stands
disposed of. The defendants are directed to file Written
Statement along with reply to the application under Order 39
Rule 1 and 2 CPC on or before the NDOH with advance copy to
the other side. Replication, if any, be filed with advance copy to
the other side.
Re-list for completion of pleadings and
arguments on the application under Order 39 Rule 1 and 2
CPC of the plaintiff on 11.07.2024.
