Present: Complainant with ld counsel Sh. K.P. Singh.
Sh. Sanjeev Bhardwaj, Ld counsel for the accused.
Accused absent.
Matter is at the stage of settlement/CE.
Both parties submit that matter received back unsettled from
mediation centre.
Previous cost subject to which NBWs were cancelled has been
paid. Receipt be taken on record.
Ld counsel for the accused submits that he has no instructions from
the accused for his appearance today. The accused has not even appeared
through VC. Even on LDOH, NBWs of accused were cancelled with warning to
remain careful in future.
Considering the previous conduct and submission of ld counsel for
the accused,fresh NBWs be issued against the accused upon filing PF by
the complainant within 15 working days and NBWs be executed by the
concerned DCP.
No application U/s. 145(2) NI Act received till date.
It is clarified that if the aforesaid application is allowed on
NDOH, the cross examination of the complainant shall be conducted on
the same day.
Both the parties are directed to remain present in person on
NDOH.
Put up for arguments on application U/s. 145(2)NI Act/CE on
31.05.2025.
