None for the proposed accused.
Matter is fixed for consideration of the application for condonation of
delay.
The matter has been called twice. However, no one has appeared on
behalf of the proposed accused.
Ld. counsel for the complainant submits that the delay in filing the
present complaint was caused due to the illness of the main counsel for the
complainant. Further, since the complainant had many matters to file, all the matters
had to be kept on hold due to the illness of the counsel.
No repy filed by the proposed accused.
Application perused and arguments heard.
The reasons cited by the complainant seems to be plausible and are
prima facie sufficient to condone the delay cause in filing the complaint. Court is of
the view that the delay which is backed by a plausible reason shall not have any
bearing on the case of the complainant atleast at this stage of proceedings.
In view of the same, the delay in filing the present complaint is
condoned subject to payment of cost of Rs.1000/- to the proposed accused.
Application stands allowed.
Put up for arguments on cognizance of summoning for 23.04.2026.
