Accused with ld counsel Sh. Ranvijay Kumar and Sh. Abhishek
Gupta.
Matter is at the stage of framing of notice.
Fresh vakalatnama filed on behalf of the accused. Same be taken
on record.
Mediation settlement order dt. 06.06.2024 supplied by ld counsel
for the complainant. Taken on record. The aforesaid mediation was referred in
CC NO. 193/2024, in which the present case has also been settled as the
connected matter.
Ld. Counsel for the complainant submits that schedule of payment
has been expired in September 2024 and no payment has been received qua the
aforesaid settlement, therefore he prays that matter be proceeded with.
Ld. Counsel for the accused submits that the aforesaid settlement
was not entered voluntarily by the accused and he has declined to accept the
aforesaid mediation settlement and is ready to contest the case.
Notice U/s 251 Cr.PC r/w Section 263(g) Cr.PC has been served
upon the accused and his/her plea of defence is recorded.
The statement of accused under section 294 Cr.PC admitting
certain documents / facts is also recorded separately.
Keeping in view that accused has admitted certain facts/ documents
which have been exhibited in original on the instructions of the court by the
Reader-cum-Ahlmad of this court and stamp of the court has been put, formal
witnesses mentioned at serial no.2 &3 in the list of witnesses attached
with the present complaint by the complainant are thereby dropped.
Accused is directed to file application U/s. 145(2) NI Act with
advance copy to other side within 30 days.
It is further clarified that if the application gets allow on NDOH,
cross examination shall be conducted on the same day and adjournment will not
granted to counsel for the accused on the ground of further preparation.
Put up for arguments on application U/s. 145(2)/CE on 31.07.2025.
