On the LDOH, status report regarding the progress of investigation was
called from the concerned SHO. The same has not yet been received.
In the case of State Sakiri Vasu Vs. State of UP (AIR 2008 SC 907)
Section 156(3) Cr.P.C provides for a check by the magistrate on police performing its
duties under chapter XII Cr.P.C. In case where the Magistrate finds that police has not
done its duty of investigating the case at all or has not done it to the satisfaction, he
can issue directions to the police to do investigation and monitor the same. Section
156(3) Cr.P.C though briefly worded includes all such incidental powers as necessary
for ensuring a proper investigation of the case.
The FIR was lodged way back on 8.7.2025. IO has not stated anything
about the progress of the case.
Let the status report with respect to investigation be called through the
concerned DCP under his own signature for 17-2-2026.
