1. The registered owner has filed the present
application for release on superdari, the vehicles bearing
registration no. DL5SCG 9878.
2. Reply of IO received, wherein it is stated that the IO has
no objection if the vehicle is released, as it is no more required
for investigation.
3. I have gone through the documents on record.
4. Certain guidelines have been laid down in Sundarbhai
Ambalal vs. State of Gujrat (2002) 10 SCC 283 and Manjit Singh
vs. State (2014) 214 DLT 646 for dealing with applications under
Section 451 CrPC. Considering the facts and circumstances,
nature of offence and law laid down, vehicle mentioned above be
released to the applicant by IO, if insured on the date of
commission of offence on furnishing security bond as per the
valuation report of vehicle and after preparation of panchnama
and taking photographs of vehicle (from all angles), counter
signed by complainant and the person who is being given the
custody. Copy of RC be retained and address of applicant be
verified before release. Panchnama, photographs (alongwith
negatives), valuation report and security bond shall be filed
along-with final report. Seized documents, if any, be also
released.
5. The Owner shall produce the vehicle before this
court as and when directed by this court and shall not transfer
ownership of the vehicle to anyone, nor possession of the same
will be parted with, until the disposal of this case. Further, the
owner shall not change the colour or appearance of the vehicle.
6. Copy be sent to the applicant and SHO.
