Accused is present.
Matter is at the stage of CE/ furnishing of bail bonds.
Vide previous order, the proposed accused had appeared after
service of dasti court notice and an opportunity under proviso section 223 of
BNSS was accorded to the propsoed accused. Although, no formal summoning
order has been passed on LDOH inadvertently, but the court has taken
cognizance of offence and upon prima facie satisfaction of ingriedients of the
offence, sufficient grounds were made out against the accused Vivek Kumar
Pandey. Accordingly, notice was served upon the accused and his plea of
defence u/s 251 Cr.PC r/w section 263 (G) Cr.PC was recorded and accused was
directed to furnish bail bonds on NDOH, upon grant of bail.
Bail bonds furnished, considered and accepted.
Vide previous order, upon oral submissions of the accused, his right
to cross examine the complainant is allowed.
Matter is adjourned at reqeust of complainant as she is indisposed
today.
Both the parties are directed to remain present on NDOH.
Put up for CE on 17.05.2025.
