Accused in person.
Vide previous orders dt. 20.12.2024 and 27.01.2025, last
opportunity was granted to the accused to argue on the application u/s. 143A NI
Act on behalf of complainant and application filed U/s. 311 Cr.P.C. on behalf of
accused. On LDOH, it was observed that the main counsel for the accused has
not appeared despite several opportunities and he was directed to appear on
NDOH for purpose of advancing arguments on the aforesaid applications.
Despite specific direction, ld counsel for the accused is not available.
Therefore, the application filed under Section 143A NI Act shall be
decided without hearing arguments on behalf of accused and the application
already on record shall be adjudicated accordingly.
Ultimate opportunity is granted to the accused to argue on the
application U/s. 311 Cr.P.C. subject to cost of Rs.3,000/- to be paid to the
complainant. Cost paid.
Accused is directed to remain present in person on NDOH.
Put up for orders on application U/s. 143A NI Act/DE on
01.05.2025.
