Present: Sh. S.G. Goswami, Ld. Counsel for complainant with
complainant.
Submissions heard.
It is stated by Ld. Counsel for complainant that requirement of
Section 173(4) Cr.PC has been complied with. It is stated that the complainant had
already approached the SHO as well as DCP concerned, however no action has
been taken by them.
In these circumstances, the SHO and ACP concerned are directed to
file report in terms of Section 173(1) and u/s 173(4) of BNSS stating the
following:
(i) whether any complaint has been made by the complaint in
the police station concerned? If yes, on which date?
(ii) whether any action has been taken by the police on the said
complaint? If yes, what action has been taken?
(iii) whether result of inquiry, any cognizable offence is made
out against the accused persons? If yes, whether any FIR
has been registered and the stage and status of the
investigation?;
(iv) If no cognizable offence is made out, whether complainant
has been informed accordingly.
The complainant is directed to supply extra copy of the complaint to
the Ahlmad/Naib Court so that the same can be attached with the notice. Copy of
complaint is already on record.
Enquiry Officer to ensure that status report is forwarded by SHO
concerned. Put up for filing of report/consideration on 09.09.2026.
Copy of this order be sent alongwith notice upon SHO concerned.
