In furtherance of order dt. 05.08.2024, the e-filing history has been
already been filed by the complainant on LDOH. As per screen shot from E-
courts website, the date of 15.07.2024 is reflected but on CIS Kiosk, the date of
filing is 29.07.2024. Therefore, complainant is directed to file application
for condonation of delay on NDOH.
Perusal of record shows that as the complaint is filed after the 1st of
July 2024, therefore provisions of BNSS apply in this case.
Let Dasti Court notice for NDOH be issued to the proposed
accused U/s. 223 BNSS 2023 granting him an opportunity of being heard
before formal summoning, after filing of the PF/RC within 15 days.
Complainant is directed to annex copy of complaint
alongwith documents and copy of application for condonation of delay
with dasti court notice.
It is clarified that only one opportunity is being granted to propose
accused.
