Complainant is absent.
Perusal of the record reveals that an application for
discharge of accused is pending for adjudication.
Ld. counsel for complainant submits that he has not
received the copy of the said appplication till date.
Ld. counsel for accused submits that she shall file spare
copy of thes aid application.
Ld. counsel for complainant is at liberty to obtain the
same from the Court Staff against aknowledgment and for reply of the
said application on or before NDOH with advance copy to the
accused.
Last and final oportunity is granted to the State as well
as complainant for filing of the reply of the said application.
Ld. counsel for accused has placed on record copy of
order passed in writ petition Cr. No. 2126/21 by the Hon’ble High
Court of Delhi and withdrawn the attention of the Court at para no. 2,
as per which, the writ petition is already disposed of with liberty to
the petitioner to take all contentions before this Court.
