Present: Ld. Counsel for the complainant alongwith complainant.
Ld. Counsel for the accused alongwith accused.
Ld. Counsel for the accused is directed to file his vakalatnama or memo
of appearance on behalf of the accused.
Accused is directed to furnish personal bond in the sum of Rs. 25,000/-
with one surety of the like amount since he/she is released on bail as the offence is
bailable in nature.
Let the abovesaid documents be filed through e-portal and originals be
handed over to the Reader-cum-Ahlmad of this court.
Notice U/s 251 Cr.PC r/w Section 263(g) Cr.PC has been
served upon the accused and his/her plea of defence is recorded.
The statement of accused under section 294 Cr.PC admitting certain
documents / facts is also recorded separately.
Keeping in view that accused has admitted certain facts/ documents
which have been exhibited in original on the instructions of the court by the Reader-
cum-Ahlmad of this court and stamp of the court has been put, formal witnesses
mentioned in the list of witnesses attached with the present complaint by the
complainant are thereby dropped.
Ld. Counsel for the accused requests to try the present matter as a
summon trial. I am of the opinion that the present case may be tried as the summon case
since accused has a plausible defence which needs detailed examination of witnesses.
Thereby the present case shall be tried as summon case.
Ld. Counsel for the accused orally request to recall the complainant for
the purpose of cross examination. Heard. Allowed.
Put up for cross examination of complainant on 21.07.2023.
