Present: AR for the complainant with counsel Ms. Himani Mudgal.
Mr. Dilshad Khan, Ld counsel for the accused alongwith
accused.
Accused absent.
Matter is at the stage of CE.
Bail bonds are not furnished by the accused.
Exemption application moved on behalf of the accused, however
same is not accompanied with the medical document. Perusal of record shows
that from the last two dates adjournment is sought by the accused/counsel for the
accused today. Today is the third date, when not only the exemption but also the
adjournment is sought.
Exemption is allowed subject to the cross examination of the
complainant. Ld counsel for the accused submits that he cannot cross examine
the complainant in absence of the accused and also he is not in a position to
reach the court. Accordingly, exemption is rejected.
Let fresh NBWs be issued against the accused upon filing PF by
the complainant within 15 working days and NBWs be executed by the
concerned SHO.
Last opportunity to the accused to argu on the application
U/s. 143A NI Act and cross examination of the complainant.
