Present: Mr. Firoz Alam, Ld. Counsel for decree holder with
decree holder.
None for JDs.
Notice sent to JDs have come back unexecuted with a
report that they have left the said address. Under the decree, JD-1 is
required to specifically perform an agreement to sell subject to
payment of Rs. 3 lac to be paid by decree holder.
Accordingly, let decree holder place on record an FDR of
the aforesaid amount favouring the Court and a copy of the proposed
conveyance deed which JD-1 is required to execute in favour of
decree holder.
On filing of the above, let copy of the said proposed
conveyance deed be sent to JD-1 at the address available on record
with court notice and the said proposed sale deed and court notice be
affixed outside the Court as well as a conspicuous place outside the
premises of JD, in case JD-1 is not found at the address sought to be
served. Thereafter, JD-1 shall be at liberty to file her objections, if any,
to the proposed conveyance deed within 30 days from service.
Let PF be filed.
