Present: Sh. Pankaj Tyagi, Ld. Counsel for plaintiff with
plaintiff in person.
Sh. Sanjay Bahuguna, Ld. Counsel for defendant.
An application has been filed by the plaintiff for taking on
record the transcript of the telephonic conversation between the
plaintiff and defendant dated 01.09.25, 05.09.25 and 11.09.25. It
is pointed out that the said conversations are of the year 2024 but
inadvertently, the year has been mentioned as 2025. The said
application is allowed and the year mentioned in the said
conversations be read as ‘2024’. Copies thereof already stands
supplied to the defendant.
The said conversations taken on record are subject to proof
since Ld. Counsel for defendant has not only denied the factum
of said conversations but also the document.
Affidavit in evidence of the plaintiff is already on record
and copy stands supplied. Let affidavit of remaining witnesses as
named in the list of witnesses be filed before the next date with
advance copy to Ld. Counsel for defendant.
Put up for PE on 24.04.2026. It is made clear that no
adjournment shall be granted for recording of evidence.
