1. D-1 has moved IA no. 2/26 seeking setting aside of ex-parte
proceedings dated 19.01.2026. Copy supplied.
2. Arguments heard.
3. It is the contention of D-1 that D-1 was never served with the
summons of the suit and only recently, plaintiff disclosed that the
present suit is pending. Perusal of file shows that summons through
ordinary modes were served on the wife of D-1 namely Ruchi Dubey
on 02.12.2025 and thus, the contention of D-1 qua non-service is
contrary to record. Thus, the application is misconceived. It is
dismissed.
4. Counsel for D-1 submits that he is entering appearance on behalf of
D-2 to D-6 (except D-4) also. Let
vakalatnama on behalf of said
defendants be filed within 10 days from today.
5. At this stage, with joint consent of parties, matter is referred to
Mediation for 05.10.2026 at 12:00 PM.
6. List before this court for outcome of mediation, and alternatively for
