the State.
The appeal was received on dated 21.10.2023
against the impugned judgment dated 09.06.2023, passed by the
court of Ms. Nidhi Bala, Ld. MM (Mahila Court)-03, Shahdara,
KKD Courts, Delhi, vide which, this appellant/convict has been
convicted u/s. 138 of the Negotiable Instruments Act and order
on sentence dated 16.08.2023, passed by the court of Sh. Snehil
Sharma, Ld. MM (NI Act), Digital Courts, North-East District,
Karkardoooma Courts, Delhi alongwith the application u/s. 389
of CrPC for suspension of sentence.
Today, Proprietor of the appellant/convict has
appeared alongwith his counsel, who has filed an appliation u/s
5 of the Indian Limitation Act alognwith photocopies of certain
documents.
Heard the ld. Counsel for the appellant.
Issue notices of this application u/s. 5 of the Indian
Limitation Act and appeal to the respondent no.2/complainant for
the next date of hearing, on filing of the PF/RC and complete set
of documents within two days from today.

The Ld. substituted Addl. PP for State/Respondent
No. 1 has received the notice of this appeal in the court.
Since, the appellant/convict has also filed an
application u/s. 389 of CrPC for suspension of sentence. So, the
operation of the impugned judgment and order on sentence,
under appeal is suspended, during the pendency of this appeal.
The appellant/convict is admitted on bail. He is directed to
furnish personal bond in a sum of Rs.50,000/- with on surety of
like amount, to the satisfaction of the ld. Trial court, within one
week from today and on filing of same, the ld. Trial court is
directed to send the same in this court.
Notice to be issued to the respondent no. 2 /
complainant is returnable on 16.11.2023. Dasti copy of this
order be provided to the parties. Attested copy of this order be
sent to the Ld. Trial court. Record of Ld. Trial Court is
also requisitioned for the next date of hearing.
