Present: Sh. Ravinder Kumar, Ld. counsel for appellant with
appellant.
Sh. Kunal, through VC, Ld. proxy counsel for
respondent.
Respondent in person.
It is submitted by ld. counsel for appellant that till date,
not a single penny has been paid by the respondent pursuant to the
mediation settlement.
Ld. counsel for appellant submits that he wants to argue
the matter on merits.
In the morning, a pass over was sought by ld. proxy
counsel for respondent till 11.00 a.m for appearance of main
counsel. However, it is now 12 noon and an adjournment is sought
by proxy counsel for respondent stating that the main counsel is
busy in Hon’ble High Court of J&K. This is no ground for seeking
adjournment and if an adjournment was to be sought, in the morning
a pass over for appearance of main counsel should not have been
sought. In these circumstances, the matter is adjourned subject to
cost of Rs.3,000/- upon the respondent to be paid to the appellant.
Adjourned.
