Present: Appellant Sh. Ram Chandra Sharma along with his
surety Sh. Shankar Sharma in person.
Sh. CCS Tomar (appearing through V/C) ld. counsel
for respondent.
Vide my separate judgment announced in the open
court today, present appeal is allowed and the impugned
judgment of conviction dated 02.09.2024 and order on sentence
dated 05.09.2024 are set aside. Appellant is acquitted of the
charges lavelled against him in this case.
FDR in the sum of Rs.1,64,000/- as furnished by
appellant before this court be released to him. Surety stands
discharged in this appeal. Original documents, if any, be returned
after cancellation of endorsement.
However, appellant is directed to appear before trial
court on 11.11.2024 and to furnish bond u/s. 481 BNSS before
trial court in the sum of Rs.15,000/- with one surety.
TCR along with copy of judgment and this order be
sent back to the trial court.
File of appeal be consigned to record room, as per
rules.
