Heard. Perused.
Plaintiff has sued the defendant for recovery of an
amount of Rs. 3,45,500/- plus interest of Rs. 57,690/- from defendant.
It is her case that she made different payments to defendant amounting
to Rs. 6,15,500/- on various dates from June 2021 to August 2023 and
defendant had repaid a total of Rs. 2.7 lac to her leaving a sum of
Rs. 3,45,500/- as principle still to be paid back.
Perusal of plaint with documents show that save and
except four transactions between the parties detailed below, all the
other transactions between the parties were before September 2022
and therefore, a question arises as to whether the money given on or
before September 2022 is within limitation or not. Plaintiff is called
upon to address arguments on the said aspect.
