Rule 1 & 2 of the Code of Civil Procedure, application under Order VII
Rule 11 read with section 151 of the Code of Civil Procedure, application
under section 5 of Limitation Act read with section 151 of the Code of
Civil Procedure and copy of General Power of Attorney, dated
01.09.2022 have been filed on behalf of defendant. Spare copy of same is
placed on record to be collected by the plaintiff.
It is submitted on behalf of defendant that the present suit is
not maintainable before this Court as this Court has no territorial
jurisdiction to entertain the present suit in view of section 145 of
Electricity Act, 2003.
As Ld. Counsel for plaintiff now is not present. In these
circumstances, put up for reply and arguments on the abovesaid
application on 19.12.2024.
