It is brought to the notice of this court that yesterday
evidence of DW-1 was recorded and during the cross-
examination, documents Ex. DW1/P-1 and Ex. DW1/P-2 were
brought to the witness and filed on record which were not earlier
filed. Defendant objected that these documents could not have
been taken on record being not filed at the relevant stage. The
submission has substance. Ld. Counsel for the plaintiff submits
that order XI Rule 1 (c) CPC allows the plaintiff to file the
documents at all stages. This submission has no basis.
The documents accordingly exhibited as Ex. DW1/P-1 and
Ex. DW1/P-2 shall not be read in evidence.
DW-1 is still to be cross-examined. Let evidence of
