Present: Sh. Vikash Kumar, Ld. Addl. PP for the State with
IO/ACP Vijay Pal Singh Tomar.
All accused persons are present after service of
summonses to them alongwith their respective
counsels.
1. None of the accused persons was arrested prior to filing of
challan.
2. Bail applications for accused Bijender Sharma and Yogesh
Sharma have been moved. Heard.
3. Since the accused persons were not arrested prior to filing of
challan, no useful purpose would be served by sending them
behind the bars now. Accordingly, they are admitted to court
bail subject to furnishing PB/SB in the sum of Rs. 10,000/-
each with one surety. Bail bond furnished by accused
persons. The same has been accepted provisionally till
NDOH and be verified for NDOH.
4. Fresh Vakalatnama has been filed on behalf of accused
Mohan. Taken on record. Ld. Counsel for accused Mohan
seeks time to file bail application for accused Mohan.
Granted.
5. IO/ACP Vijay Pal Singh Tomar is present and seeks time to
supply copies of challan to the accused persons and
complainant. The accused persons submit that they have

been falsely implicated in the present matter as accused
Bijender Sharma had a residential house where he lived
alongwith other family members and co-accused Yogesh
Sharma who is his son and he sold the same to other co-
accused Mohan and decline the request of complainant who
wanted to purchase it. This enraged the complainant and she
made false complaint against all of them. Previously also,
she attempted to implicate them in false case. The IO
submits that this aspect was not disclosed by accused
persons to him and further investigation shall be conducted
in this regard.
6. Inadvertently, notice of filing of challan could not be issued
to the complainant. Therefore, issue notice to the
complainant for NDOH. Put up on 18.10.2024.
