Order Details: COPY OF ORDER Pdf Text: SC No. 162/2023 State Vs. Ansar FIR No. 271/2023 PS: Dayal Pur 29.11.2023 Present: Sh. Masood Ahmad, Ld. Addl. PP for the State. Accused produced in JC. Sh. Sarfraj Asif, Ld. Counsel for the accused. Sh. Shailender Agnihotri, Ld. Proxy counsel for the complainant. The matter is fixed for order on the protest petition filed by the complainant and also for consideration on the charge. Today, on calling the case, accused has been produced in JC. Ld. Counsel for the accused has appeared. The Ld. Addl. PP for the State has submitted that prima facie case u/s. 498-A/304-B of IPC is made against the accused Ansar and charges, in the said sections are liable to be framed against this accused. On the other hand, the ld. Counsel for the accused has submitted that he does not want to argue on charge and submitted that charges, in the same section, may be framed against the accused. This court finds that prima facie case u/s. 498- A/304-B of IPC is made out against the accused and charges, in the same sections, are liable to be framed against the accused. -- 1 of 2 -- -2- Accordingly, charges u/s. 307/34 of IPC 498-A/304- B of IPC have been framed against the accused, to which he has pleaded not guilty and claimed trial. Accordingly, the matter stands adjourned for evidence of the prosecution. To come upon 21.02.2024 and 22.02.2024. Public witnesses be summoned at the first instance alongwith the IO and the MHC(M). Since, this court remained busy in examining the witnesses in a time bound case and other cases and now, no court time is left, so, the matter is ordered to be listed on 30.11.2023 at 3:30 PM, for order on the protest petition filed by the complainant.
