Reply to the appeal has been filed on behalf of
respondent no. 2.
Ld. Counsel for the respondent no. 2 is directed to
supply the copy of reply to Ld. Counsel for the appellant.
Ld. Counsel for the respondent no. 2 has stated that the
copy of reply to be provided to the appellant is already on record.
Appellant is at liberty to obtain the same from the judicial record
against proper acknowledgment and receipt.
Perusal of the record reveals that the respondent no. 1
could not be served till date.
An application under Order V Rule 20 read with section
151 of the Code of Civil Procedure has been moved on behalf of
appellant for substituted service of respondent no. 1.
It is stated that the notice issued to respondent no. 1
was received back unserved with the report no such person resides
at the given address. Ld. Counsel for the appellant has stated that the
respondent no. 1 was a tenant and she has vacated the premises. He
has further stated that he is unable to trace out the fresh address of
the respondent no. 1. He has thus, prayed that the respondent no. 1
be served by way of substituted service in a newspaper.
