DHs have filed certified copy of final decree.
1. It may be noted that as per the execution petition, five persons have
come before this court who have described themselves as DHs.
While DH-1 to DH-4 were P-1 to P-3 and P-5 in the suit, DH-5/Ved
Prakash was D-2 in the suit.
2. D-1/Om Prakash has been arrayed as the sole JD in this case. Under
the decree, first an
interse auction has to be carried out between the
parties qua the suit property.
3. Accordingly, Mr. Kamal Kumar Pandey, Advocate is appointed as
the court auctioneer for carrying out
interse auction between the
parties in terms of final decree dated 18.04.2026. The base price of
the suit property for the said auction proceedings shall be in terms of
para 9 of order dated 12.12.2025. The fee of the court auctioneer is
fixed at Rs.20,000/- which shall be jointly and severally borne by all
the parties entitled to a share in the suit property and shall be paid in
advance to the court auctioneer.
4. The date of
interse auction between the parties is fixed as 27.10.2026
at 2:00 PM at the suit property where parties along with their counsel
may appear for taking part in auction proceedings.

5. DHs shall file an affidavit before the court auctioneer that there is no
stay to the present execution granted by the Hon’ble High Court of
Delhi in RFA no. 377/26.
6. List before this court on 02.11.2026.
7. Copy of this order be given
dasti to the parties and be also sent to the
court auctioneer for necessary information and compliance.
