Present: Ld. Counsel for decree holder with decree holder.
None for JD.
1. Decree holder has filed copy of proposed sale deed but on
perusal, it shows that the name of vendor/JD is not mentioned
in the same.
2. There are multiple blanks in the sale deed and the boundaries of
the property shown qua the suit property in question do not
correspond with the site plan Ex. PW1/1 based on which
specific performance was granted to the decree holder. Thus,
the proposed sale deed is taken off the record.
3. Decree holder is given strict warning that he should not make
false averments or give wrong descriptions of the property for
which he is seeking specific performance.
4. One more opportunity is granted to decree holder to file a
proposed sale deed. It should be filed alongwith stamp papers
etc after complete compliances required for registration of
conveyance deed. DH shall also file an undertaking on an
affidavit stating that the proposed sale deed is as per decree.
Once the same is filed, let Nazir file his report.
