Pleadings are complete. On the basis of pleadings of the
parties, the following issues are framed:
(1) Whether the plaintiff is entitled to a decree of
possession in respect of suit property bearing no.
C-12/499, Yamuna Vihar, Delhi, as prayed for? OPP
(2) Whether the plaintiff is entitled to a decree of
recovery of Rs. 6,50,000/- for use and occupation of the
suit property w.e.f. March, 2023 to May, 2025 and future
damages to the tune of Rs. 40,000/- per month after May,
2025 onwards? OPP
(3) Whether the plaintiff is entitled to a decree of
permanent injunction, restraining the defendants from
creating third party interest in the suit property? OPP
(4) Whether the plaintiff is entitled to a decree of mesne
profits and future damages from the date of filing of the
suit till the date of handing over possession of the suit
property along with cost of the suit? OPP
(5) Whether the suit of the plaintiff is not maintainable in
it’s present form and is liable to be dismissed? OPD
(6) Whether the plaintiff has no locus standi or cause of
action to file the present suit? OPD

(7) Relief.
Put up for PE on 17.09.2026.
Plaintiff is directed to file evidence affidavits of all
plaintiff witnesses along with list of witnesses on or before the
NDOH and supply advance copy to the opposite side fifteen days
before the NDOH.
Parties to maintain status quo till the NDOH.
