Vakalatnama filed on behalf of the defendant.
It is stated by the parties that they have settled all their
disputes in relation to the present case for a total sum of Rs.4,25,000/-.
Plaintiff states that he has already received the entire settlement
amount of Rs.4,25,000/- from the defendant. Hence, plaintiff requests
that the present suit may be dismissed as withdrawn being settled.
Separate statement of the plaintiff and the defendant
recorded to this effect.
In view of above, the present suit is dismnissed as
withdrawn being settled.
An application is moved on behalf of the planitiff
seeking return/refund of court fees.
Heard.
Learned counsel for the plaintiff states that since the
parties have settled their disputes, court fees filed by the plaintiff be
refunded to him.
In view of above, court fees of Rs.6,250/- filed by the
plaintiff in the present suit be refunded to him.
Application stands disposed of.
File be consigned to the record room.
