1. An application seeking judicial remand of accused Israr @ Asrar
@ Popat, Asif @ Batla, Adnan and Suhail @ Chappal, for 14
days has been filed by IO. Copy of the application supplied to the
defence counsels.
2. One bail application has already been filed by accused Asif @
Batla.
3. Heard and perused. Yesterday itself in the order passed on bail
application of Asrar, in the present case, this court has taken a
view that MCOCA is not validly invoked in the present case and
bail order has been passed in favour of accused Israr @ Asrar @
Popat. It is a different matter that till now bail bonds are yet to be
accepted. In the background of afore-said decision taken by this
court, it cannot be said that ground for further custody of these
accused persons is made out. Therefore, this application for
seeking further judicial remand of the afore-said accused persons
is declined.
