plaintiff.

It is requested by both parties that as the pleadings are
complete issues be framed. It is requested by both parties that issues
are necessarily be required to be framed so that evidence be taken on
the next date of hearing. As admission-denial is not pressed for and at
request of the parties following issues are hereby framed:-
(i) Whether the plaintiff is entitled for decree of partition
in favour of plaintiff and against the defendants, as prayed for, in
prayer clause (1)? OPP
(ii) Whether the plaintiff is entitled for decree of
permanent injunction in favour of plaintiff and against the defendants,
as prayed for, in prayer clause (b)? OPP
(iii) Whether the suit of the plaintiff is bad because of
mis-joinder of parties? OPD
(iv) Whether the suit of the plaintiff is not maintainable
as the suit property has already been partitioned? OPD
(v) Relief.
No other issue arises or is pressed for.
Put up for PE on 27.08.2024. Both the parties are directed
to file their list of witnesses alongwith evidence by way of affidavits
within 15 days from today with advance copy to each other side.
