Accordingly, as the pleadings are complete, following issues are
being framed:-
(i) Whether the plaintiff is entitled to decree of specific
performance, as prayed for, in prayer clause (a)? OPP
(ii) Whether the plaintiff is entitled to decree of
declaration, as prayed for, in prayer clause (b)? OPP
(iii) Whether the plaintiff is entitled to decree of
possession, as prayed for, in prayer clause (c)? OPP
(iv) Whether the plaintiff is entitled to decree of
permanent injunction, as prayed for, in prayer clause (d)? OPP
(v) Whether the plaintiff is entitled to decree of
recovery of Rs. 28,00,000/- alongwith past/future interest at the rate
of 15% per annum, as prayed for, in prayer clause (e)? OPP
(vi) Whether the plaintiff is entitled to decree of
damage/mesne profit, as prayed for, in prayer clause (f)? OPP
(vii) Whether the suit of plaintiff is bad for mis-joinder
of parties? OPD1 & D3.
(viii) Whether there is no cause of action in favour of
plaintiff and against the defendants for filing the present suit? OPDs

No other issue arises or is pressed for.
Put up for PE on 25.03.2025. Both the parties are
directed to file their list of witnesses alongwith evidence by way of
affidavits within 15 days from today with advance copy to each
