Present: Sh. V.K. Sharma, Ld. Counsel for applicant. Applicant herein was P-1 in CS no. 367/18 and he on his behalf as well as on behalf of P-2 to P-4 and on behalf of D-2 have filed stamp papers cumulatively amounting to Rs.48,000/-. It is not clear from the application how the applicant has arrived at the said amount. I may note that a final decree of partition dated 26.11.2025 was ordered in the above matter and the drawing up of final decree was conditional on the deposition of stamp duty. Since there is no valuation placed on record by the applicant which has been made the basis of paying the stamp duty and since no stamp duty is being paid for the remaining person i.e. D-1/Om Prakash, no final decree of partition can be drawn at this stage. Counsel for applicant submits that he needs to seek instructions as to whether his clients are willing to pay the stamp duty payable by D-1/Om Prakash and also file valuation of the property.
