Arguments heard on the application of defendant filed under
Order 7 Rule 11 CPC.
Both parties claim ownership over the piece of land which has
different khasra number in the title documents of both the parties, but
the plot is claimed to be the same. The thrust of arguments of the Ld.
Counsel for defendant is that the present suit is without any cause of
action, having been filed on the basis of unregistered documents and
therefore, the suit deserves to be dismissed under Order 7 Rule 11
CPC. Reliance has been placed on various case laws in support of the
arguments.
On the other hand, Ld. Counsel for plaintiff has made
submissions that the defendant has come into possession of the suit
property on the basis of forged documents which are also
unregistered, but since he was not aware about the exact khasra
number, therefore a different khasra number appears on his set of
documents, though the plot is the same. He also alleges that the
defendant is having muscle power which he has been using against the
plaintiff.
In order to ascertain the exact khasra number of the suit plot, let
a report from the SDM/Patwari, Karawal Nagar be sought for
31.10.2026.
