Present: Ld. Counsel for plaintiff with plaintiff.
Ld. Counsel for D-1 with D-1.
D-3 in person.
None for other defendants.
Summons sent to D-2 have not come back. D-3 submits that
D-2/Asha Devi is not keeping well.
D-2 has also filed a letter addressed to Court seeking a date.
The said letter is taken on record. Thus, D-2 is treated to have been duly
served.
All the served defendants are at liberty to file their written
statement within 30 days from today with advance copy to the other side.
Summons sent to D-4 have come back with the report that
address could not be traced.
In view of the above, D-1 to D-3 have been served. Copy of
paper book has been supplied to D-1 and D-3 in Court.
Let D-4 be served again through all permissible modes, on
filing of PF, returnable for next date of hearing.
At this stage, plaintiff and appearing defendants want that the
matter be referred to Mediation. Thus, the matter has been identified to be
referred to Mediation for 23.05.2026 at 3:00 PM. This is in terms of
directions received as per letter dated 28.11.2025 of MCPC, Supreme Court
of India under the heading ‘Mediation for the Nation 2.0'.
List before this Court for report on settlement on 07.08.2026.
