None for the defendant no. 1 despite repeated calls.
Defendant no. 2 in person alongwith Sh. Pawan Kumar
Shishodia and Sh. Tarun Kumar, Ld. Counsels for the
defendant no. 2.
An application under Order VII Rule 14 read with
section 151 of the Code of Civil Procedure has been moved by the
plaintiffs seeking leave to file the document i.e. Agreement Deed
dated 30.07.1990 executed by Sh. Rajan in favour of the father of
the plaintiffs.
It is stated that the plaintiffs have filed the evidence by
way of affidavit and while going through the case file, lately they
came to know that the agreement deed dated 30.07.1990 which was
executed by Sh. Rajan in favour of the father of the plaintiffs has not
been filed on record. Hence, permission has been sought to file the
same.
In reply to the said application by defendant no. 2, it is
stated that the plaintiffs are trying to fill the legal lacuna and that the
prayer should be disallowed.
The application is merely formal in nature hence, the
same is hereby allowed. Let the agreement deed dated 30.07.1990
be taken on record.
