Defendant no. 1 is not present despite repeated calls. Sh. Pawan Kumar Sisodiya, Ld. Counsel for defendant no. 2 along with defendant no. 2. It is submitted by Ld. Counsel for defendant no. 2 that he has not received the complete set of documents. It is also submitted that they are unable to make submissions on the application of plaintiff under Order XXXIX Rule 1 & 2 r/w Section 151 CPC. Same is objected to by Ld. Counsel for plaintiff. Ld. Counsel for plaintiff submits that defendant no. 2 is deliberately not filing the reply. In the interest of justice, one more set of documents have been supplied to the Ld. Counsel for defendant no. 2 today itself. Further, defendant no. 2 is at the liberty to make submissions on the application of the plaintiff under Order XXXIX Rule 1 & 2 r/w Section 151 CPC positively on the next date of hearing. Put up for making of submissions, if any/clarifications on 06.04.2023. It is requested by Ld. Counsel for plaintiff that his suit be infructuous if suit property be not protected, as defendant is also present before the court therefore, it will be not inconvenient for any -- 1 of 2 -- of the parties if status quo be maintained qua the suit property. Thus, till the next date of hearing status quo be maintained by both the parties qua the suit property. At request, copy of order be given dasti.
