Accordingly, as the pleadings are complete, following issues are being
framed:-
(i) Whether the plaintiff is entitled for decree of declaration,
as prayed for, in prayer clause (A)? OPP
(ii) Whether the plaintiff is entitled for decree of permanent
injunction, as prayed for, in prayer clause (B)? OPP
(iii) Whether the defendant no. 2 is the owner of the suit
property i.e. built up property, built on land area measuring 150 square
yards i.e. 125.4 square metres bearing property number E-2/630, out of
khasra number 54/1/4, situated in the abadi of 4½ Pusta, Bhagat Singh
Marg, Post Office Wali Gali, Sonia Vihar, in the area of Village
Beharipur, Illaqa Shahdara, Delhi and is in the possession of the same?
OPD2.
(iii) Relief
No other issue arises or is pressed for.
Put up for PE on 28.03.2023. Both the parties are directed
to file their list of witnesses alongwith evidence by way of affidavits
within 15 days from today with advance copy to each other side.
