Present: Sh. M.L Sharma, ld. counsel for plaintiff along with
plaintiff.
Sh. Saurav, ld. counsel for defendant along with
defendant.
WS filed on 09.01.2024. Ld. Counsel for defendant submits
that the advance copy was supplied to the ld. Counsel for plaintiff through
whats-app. Ld. Counsel for plaintiff submits that he has not received the
copy of the same. To avoid any controversy, copy supplied today in the
court.
The WS was filed with delay. Delay condoned subject to cost
of Rs.1000/- to be paid to plaintiff on NDOH. Previous cost of Rs.1000/-
be also paid by defendant on NDOH.
Ld. Counsel for plaintiff submits that he does not wish to file
the replication. Pleadings are complete.
It is not in dispute that the cheque bears the signatures of
defendant no. 1. Admission/denial of the documents not pressed. Parties are
directed to prove their documents, as per law.
From the pleadings of the parties, following issues are framed
as under :
(i) Whether the plaintiff is entitled to decree for a sum of
Rs.3,20,000/-, as prayed for ? OPP
(ii) Whether the plaintiff is entitled to interest, if so, at
what rate and for which period ? OPP
(iii) Relief.
No other issue arises or is pressed by the parties at this stage.
List of witnesses be filed by the parties within fifteen days. Affidavit(s) of
the plaintiff ’s witness(es) be filed within two weeks with advance copy to
the opposite party against receiving two days prior to the next date of
hearing.
