Vide my separate judgment announced in the open court
today, the judgment dated 24-11-2023 and order on sentence
dated 22-01-2025 passed by ld. Trial Court are set aside. The
matter shall be remanded back to Ld. Trial Court with direction
to grant one effective opportunity to the appellant to cross-
examine PW1 and PW6 and thereby to proceed as per law and
pronounce judgment in light of testimonies of PW1 and PW6.
The appeal stands disposed of. Trial Court record be segregated
and returned to the Ld. Trial Court with copy of the judgment and
thereafter, appeal file be consigned to Record Room.
