Counsel for respondent had argued that there is a delay of one day in filing of present appeal as the impugned judgment and decree is dated 08.01.2026 and the present appeal was filed only on 10.02.2026. Perusal of appeal record shows that the certified copy of the impugned judgment and decree was applied by appellant/plaintiff on 15.01.2026 and it was ready for delivery on 17.01.2026. If the said period is accounted for, there is no delay in the filing of the present appeal. Appellant has deposited the deficient court fees in filing of the appeal. It is taken on record. Arguments on the appeal heard. During the arguments, counsel for respondent submitted that a suit for specific performance was filed by respondent against appellant herein bearing CS no. 476353/2014 and the same was adjourned sine die vide order dated 20.08.2015.
