Reply to the application under Order 7 Rule 14 CPC filed
by the plaintiff, filed. Copy supplied. At this stage, Ld. Counsel
for the plaintiff wants to withdraw the said application. His
statement recorded separately.
In view thereof, the said application is dismissed as
withdrawn.
The defendant has also filed an application under Section
151 CPC for directing the plaintiff to file original documents and
to refer them to FSL. The said application is not required since
the plaintiff has to prove his own case and tender the original
documents at the time of evidence. The contention that the
documents are forged and fabricated can only be decided once
the plaintiff proves the original documents and place them on
record. The apprehension of the defendants that the plaintiff
would hide the said documents would also go against the plaintiff
in case he does so.
Hence, at this stage, the said application is not
maintainable and is accordingly dismissed.
No reply to the application under Order 12 Rule 6 CPC has
been filed by the defendants.
