Present : Sh. R. Shukla, Ld. Counsel for plaintiff.
Sh. Mukesh Gupta, Ld. Counsel for defendant through VC.
In the first call one counsel has appeared on behalf of defendant through
Video Conferencing stating that he will file fresh Vakalatnama within the course of the day.
Now, despite repeated calls, none has appeared on behalf of defendant. In these
circumstances, it is requested by Ld. Counsel for plaintiff that as already defence of
defendant had been struck off, therefore, issues be framed and matter be proceeded further.
Thus, at request of the Ld. Counsel for plaintiff following issues are hereby framed:-
(i) Whether the plaintiff is entitled to decree of possession in favour of
plaintiff and against the defendant, as prayed for, in prayer clause (i)? OPP
(ii) Whether the plaintiff is entitled to decree for recovery of Rs.
3,60,000/- in favour of plaintiff and against the defendants, as prayed for, in prayer clause
(ii)? OPP
(iii) Whether the plaintiff is entitled to decree for recovery of Rs. 20,000/-
per month in favour of plaintiff and against the defendant, as prayed for, in prayer clause
(iii)? OPP
(iv) Whether the plaintiff is entitled to decree of permanent injunction in
favour of plaintiff and against the defendants, as prayed for, in prayer clause (iv)? OPP
(v) Relief.
No other issue arises or is pressed for.
Put up for PE on 21.07.2025. Both the parties are directed to file their list
of witnesses alongwith evidence by way of affidavits within 15 days from today with
advance copy to each other side.
