Memo of appearance is filed.
Ld. Counsel for plaintiff has filed proof of service
i.e. the speed post receipts as well as their tracking reports which
shows that summons were delivered to defendant on 28.05.2025.
Ld. Counsel for defendant submits that the defendant
has not received the copies of plaint and documents. I have also
perused the original speed post receipts, which show the weight
of the envelop only 20 gram. Ld. Counsel for plaintiff fairly
concedes and submits that he will supply the copies of plaint and
documents to the defendant during the course of day.
Let written statement along with Statement of Truth
and affidavit of admission-denial of plaintiff’s documents be filed
within stipulated period with their advance copies to the plaintiff.
Plaintiff is directed to file replication thereafter
within ten days alongwith affidavit of admission-denial of
documents of defendant, if any, with their advance copies to the
defendant.
Put up for framing of issues on 09.07.2025.
